INITIAL MATTERS AND DEFINITIONS:

Unless otherwise defined herein, defined terms are the same as in Stoney Points Terms and Conditions.

Information Types. “Stoney Point Capital LLC”, “Stoney Point Capital”, “Stoney Point”, “we,” “us” and “our” means Stoney Point Capital LLC. “You” and “your” mean the user of stoneypointinvest.com (the “Website”) or any other information or communications provided by Stoney Point (“Materials”). “Non-Personal Information” or “NPI” is any information that is not Personally Identifiable Information (defined below). Non-Personal Information includes, without limitation, Personally Identifiable Information that has been anonymized. “Personally Identifiable Information” or “PII” is non-public information we may receive from your use of the Wesbite that can be used, alone or in combination with other information in our possession, to identify a particular person/individual. It may include information such as name, address, telephone number and other personal information you provide us. “Data” includes both Non-Personal Information and Personally Identifiable Information.

Subsequent Changes to Policy. In our sole discretion, except as limited by law, we may change this Policy periodically with or without providing notice to you. If you choose to continue to access stoneypointinvest.com after the publication of subsequent changes to this Policy, your continued use indicates your acceptance of the changes. It is your responsibility to review this Policy periodically to maintain an up-to-date knowledge of the terms herein.

INFORMATION POLICIES:

Age Matters. The Materials provided on stoneypointinvest.com and by Stoney Point via other means or in other fora is not intended for individuals under the age of 18. Stoney Point does not intentionally collect information from such individuals. If you are under 18 you must seek and obtain permission from your parent or legal guardian prior accessing the Materials on stoneypointinvest.com or from Stoney Point via other fora, and prior to submitting information to stoneypointinvest.com.

General Information about Collection of Information. Viewing the publicly available pages of the Website does not require you to provide any PII. Viewing certain non-publicly available pages and accessing certain other information and Materials provided by Stoney Point, however, may require you to register and provide PII. Stoney Point may collect PII from you in a variety of ways, including, but not limited to, when you visit the Website, register on the Website, provide PII in connection with other activities, services, features, resources, and/or Materials we make available on the Website or make available via other means, such as email communications, or when you complete a transaction on the Website or through third-party applications that we have integrated into the Website for the purposes of facilitating transactions that allow you to access subscribers-only content. We may collect your name, mailing and billing addresses, phone number, payment information, and email address, among other data. We may also collect information from you showing your agreement with Stoney Point’s Terms of Use and/or showing that you have read and/or understand this Policy.

Third-Party Service Providers. We may share your information with third-party service providers (“Third Parties”, “Service Providers”, or “Third-Party Service Providers”) with which we have commercial relationships to comply with legal obligations and to facilitate providing our services to you.

Transactions and Communications. We may also collect additional information from you depending on the nature of a particular transaction you enter into with Stoney Point, or other features or communications in which you may opt to participate. Stoney Point and Third-Party Service Providers may also collect information about you automatically when you visit the Website or third-party applications via the Website. When you access the Website, we and Third Parties may automatically receive certain information from your browser or mobile device, such as your browser type, the operating system of your device, the URL of the site from which you came and the URL of the site you visit when leaving the Website. We and Third Parties may also receive your IP address and the name of your internet service provider (“ISP”) or your mobile carrier.

Geo-Locational and Activities Information. Stoney Point and Third Parties may also receive location data and other types of information sent from other third-party applications depending on your devices settings. As you use the Website, we may also collect information about such usage and your actions on the Website, such as information about any pages you viewed, the times at which you accessed the pages, and the amount of time you spent on the pages. We may use cookies to collect such information (discussed below). This information is considered Non-Personal Information, which we can use for any purpose, including, without limitation, to help us improve the Website and to enhance users’ experiences.

Conversion of PPI to NPI. We may de-identify or anonymize PII to convert it to NPI. You acknowledge that NPI and PII that is converted into NPI belongs to Stoney Point and that Stoney Point has the right to use such general information as it determines in its sole discretion. Notwithstanding the foregoing, we will treat as PII any item that, either alone or together with other information, we could use to identify an individual. Except as described below in this section and below, we will not share with third-parties the link between your IP address and your PII without your permission. By providing your PII to us, you explicitly agree to our collection and use of such information as described in this Policy. By providing PII belonging to another person, you expressly represent and warrant that you have the authority and right to do so, and that you obtained all appropriate and required consents.

Intent and Purpose. Stoney Point will only use PII for the purpose of meeting legal obligations and providing and improving our services and Materials. For example, among other things, we may use your PII to improve our customer service capabilities, to personalize user's’ experiences (but not to provide personalized investment advice, as described in our Terms and Conditions), to improve the Website, to provide the Materials, and to process transactions. Stoney Point may use NPI for product development, research, or other purposes. For example, among other things, we may use the information that you provide when placing or fulfilling a subscription, to send periodic emails, and to develop new products, services, or Materials. Except as otherwise provided in this Policy, we may use your PII and NPI internally and to offer our own or third-party products, services, and Materials. Only Stoney Point, its affiliates, including its suppliers, contractors, and Third-Party Service Provides involved in distributing any new Materials, products, and/or services will have access to your PII. Except as otherwise expressly provided for in this Privacy Policy or except as prohibited by applicable law, Stoney Point may use your PII and NPI to enhance its networking, marketing, social, and recruiting activities, and for other similar business purposes. We may also use PII and NPI to provide you information regarding new Materials, products, and/or services. PII is not shared with entities outside of Stoney Point other than service providers who assist us in carrying out these business functions. Stoney Point may disclose your PII as we may determine (in our sole discretion) is necessary or reasonably required to comply with the law, applicable regulations, court orders or subpoenas, to enforce our Terms of Use, or to protect our rights, property or safety, or the rights, property or safety of others. If ownership of Stoney Point or the Website changes, whether in whole or in part, information collected through the Website about you may be transferred to the new owner so the Website and any service provided through or related to the Website can proceed in an uninterrupted manner. In that case, your user information would remain subject to the terms and conditions of the applicable version of the Policy. Stoney Point will make a reasonable effort to keep your PII and NPI that you provide to us secure.

Cookies: When you access the Website, Stoney Point may send a “cookie” (a datum sent to your brower from a server and stored on your computer’s hard drive) to your computer, which allows Stoney Point to recognize you as a viewer, user, or subscriber when you re-access the Website using a device and browser and to identify and track your activities on the Website for the purposes detailed above. To improve the services provided on the Website, the Website’s functionality, or for advertising and marketing purposes, we may allow Third Parties to place or recognize unique cookies on your browser. In such case, the purpose of providing Third Parties such information will be to improve users’ experiences by providing tailored marketing, or to facilitate other benefits, such as payment processing. Your browser provider may provide you more information about how to manage or refuse cookies on your device or browser.

Exemptions for Electronic Communications. Stoney Point may provide information about or means of contacting Stoney Point via the Website. This Policy does not apply to content, materials, or other information you elect in your determination to transmit to Stoney Point electronically, including through social media networks, even if you access such electronic means of communication via the Website. Please do not send any information you consider private to us by such means.

Exemptions Related to Other Third-Party Websites. Stoney Point may include on the Website means, including hyperlinks, to other third party websites, the practices, policies, and contents of which Stoney Point is not responsible and has no control. Your access to, use of, and activities on such websites, even if accessed via stoneypointinvest.com, is your sole responsibility.

Additional Policy Information for Residents of the European Union. It is your responsibility not to provide PII or NPI to Stoney Point if you do not consent to having such PII or NPI warehoused in the United States. PII and NPI that you, in your sole discretion, transmit to Stoney Point as described in this Policy may be stored and accessed in servers or files in the United States of America, and the European Union may not have deemed such servers or files to provide privacy protection that is adequate. Your use of the Website and/or your transmittal of NPI or PPI to Stoney Point by other means indicates your acceptance of the storage of and the possibility of access to your NPI via such servers and files in the United States.
